This policy explains how we collect and use your data under the UK GDPR and in alignment with the South African Protection of Personal Information Act, 2013 (POPIA), and the Australian Privacy Act (1988). As the data controller, we are responsible for your personal data.

We only collect data necessary to provide our GHL-based SaaS services. We collect:

Identity information: e.g. name, address and date of birth.

Contact information: e.g. email address and telephone number.

Financial data: e.g. your payment details.

Lead data: We also process lead data (emails) provided by you to perform our services.

We do not collect sensitive data or data relating to children.

We only share personal data with third party service providers where necessary. Our verified sub-processors include:

GHL (HighLevel): For primary CRM infrastructure and hosting.

Stripe: For secure payment processing.

Meta (Facebook, Whatsapp, instagram): For communications and integrations.

Twilio & Mailgun: For SMS and Email routing.

myCRMSIM & Tiktok: For expanded communication and lead generation functions.

International Transfers

As a UK company serving a predominantly South African market, we manage international data flows. We ensure all data transferred outside the UK (e.g., to servers in the US) is protected by standard contractual clauses. This is governed strictly by the International Data Transfer Addendum to the EU Commission Standard Contractual Clauses  to guarantee data compliance across the SA, UK, and US jurisdictions.Where applicable for our Australian clientele, the processing of personal data complies with the Australian Privacy Principles and the Australian Privacy Act (1988).

2. Terms of Service

Nature of Service

Scaling Atomic Startup provides access to a software-based system (CRM), including configured automations, communication tools, and integrations. Access is provided digitally via a secure platform (Go High Level).

Cancellation Policy

Subscriptions may be cancelled at any time. To avoid the next billing charge, cancellation must be completed at least 3 days before the next billing date. If cancellation is not received within this timeframe, the next billing cycle will proceed as scheduled.

Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms.

3. Billing and Payment Policy

Upfront Payments & Subscriptions

All payments must be made in advance. No access to the system will be granted and no setup or configuration work will begin until the initial payment has been successfully received.

6-Week Billing Cycle

Initial Payment: An upfront payment is required to cover the system configuration and the first month of service.

Recurring Charges: Your second subscription charge will occur exactly 6 weeks after your initial payment. Following this, billing transitions to a standard monthly recurring basis.

Rebilling

Additional emails are billed at a rate of $1.40 USD per 1,000 emails. Usage-based charges are calculated daily and billed automatically bi-monthly to your card on file or when your balance reaches the minimum threshold.

Strict Refund Policy

All payments are non-refundable. No refunds will be issued once access has been granted or work has commenced, regardless of usage.

Exception: If you have not yet accessed the system or if we have not commenced configuration, a refund may be requested within 14 days of purchase. Once provisioning has occurred, the service is deemed 'consumed' and is non-refundable.
